SRK banned from Wankhede for 5 years: Vilasrao Deshmukh

Mumbai:  Shah Rukh Khan, the owner of the Kolkata Knight Riders, has been banned from entering Mumbai’s Wankhade Stadium for five years.    The head of the Maharashtra Cricket Association (MCA), Vilasrao Deshmukh, announced the decision this morning.

Mr Deshmkuh said that after his fight at the stadium on Wednesday night, the actor has “shown no regrets…in fact, he justified his actions.”  The MCA administers the Wankhade stadium, but the Board of Control for Cricket in India (BCCI) will make a final call on the ban, IPL chairman Rajiv Shukla had said yesterday.

A police complaint has been registered against the actor for voluntarily causing hurt and for intimidation – because this is a non-cognizable offence, SRK as he is known cannot be arrested.  The actor said on Thursday that he was provoked after security guards touched a group of children he was accompanying, which included his daughter.  Photographs of the brawl show his daughter, holding his arm as he confronts officials and the guard.  The MCA says that the actor should recognize that officials showed “great restraint” in how they handled the situation.    “If anybody behaves like this…whosoever it may be…action will be taken,” Mr Deshmukh said.  He also said that while the actor has said he was  trying to protect children, no complaint has been registered by SRK against the guards or officials.

The trouble began on Wednesday night when SRK’s team was playing the Mumbai Indians.  SRK did not attend the match but arrived there later to pick up his children and their friends.  In his police complaint, the security guard, Vikas Dalvi, says he saw SRK and his entourage in the players’ dressing room and  asked them to vacate it because it can only be used by team members.  The actor and his entourage then tried to walk onto the grounds of the stadium.  A complaint by an official of the MCA, Nitin Dalal, who was present at the fight states that SRK appeared drunk and used abusive language against officials including Mr Deshmukh.

    BCCI unhappy with Shah Rukh’s ban from Wankhede, will intervene: Sources

    The Board of Control for Cricket in India (BCCI) is expected to step in to resolve the issue of a ban on superstar Shah Rukh Khan from entering Mumbai’s Wankhede Stadium. Sources say the BCCI is unhappy with the decision of the Maharashtra Cricket Association (MCA) to bar the actor, who also owns the IPL team the Kolkata Knight Riders, from the stadium for five years.

    The sources say the board is working the back channels now to resolve the issue. It reportedly holds that the ban is not in order as IPL franchises pay for use of stadia and cricket grounds. The MCA has banned Shah Rukh from entering Wankhede even as a spectator and the association, which administers the stadium, says it is well within its right to do so. But Rajiv Shukla, who is chairman of the IPL, has said while the MCA can propose a ban, the BCCI will make a final call.

    Shah Rukh Khan, who himself is dismissive about the ban, has found political support in the last two days that he has been battling the MCA over a Wednesday evening scuffle at the Wankhade stadium after a KKR-Mumbai Indian match. Mamata Banerjee, West Bengal Chief Minister, has said she will appeal that the decision to ban him be reconsidered.

    “We love everybody, from Shah Rukh to Sachin to Sourav…But Shah Rukh is our brand ambassador…I don’t want to interfere in any other state’s business, I don’t want what I am saying distorted, this is a sensitive matter. I will appeal, please reconsider the decision,” Ms Banerjee said.

    Other politicians batted for Shah Rukh too. Like Lalu Prasad who said the ban on the actor was all wrong and suggested that the IPL be wound up. Fellow IPL team owner and MP Vijaya Mallya said, “SRK is passionate about his team and about children…IPL has no role to play here. It is strictly between the MCA and affected person regarding the entry into Wankhede Stadium.” The National Conference’s Farooq Abdullah said Shah Rukh was an icon and so must be calmer.

    Early today, the head of the MCA, Vilasrao Deshmukh, announced the association’s decision to ban Shah Rukh. He said after his fight at the stadium on Wednesday night, the actor had “shown no regrets for his action and behaviour…in fact, he justified his actions of manhandling security guards and abusing MCA officials.” Mr Deshmukh said that the MCA considered a life ban but then unanimously decided that they would ban him from the stadium for five years to send out a message.

    A police complaint has been registered against the actor for voluntarily causing hurt and for criminal intimidation – because this is a non-cognizable offence, SRK as he is known cannot be arrested. The police will study all the statements made so far by everyone involved in the incident, including eyewitnesses, to chalk out the exact sequence of events and then will corroborate it with CCTV footage from stadium. The MCA reportedly reviewed the footage before announcing its decision today.

    Shah Rukh Khan has categorically denied that he was drunk when he went to the stadium. Or that he pushed or manhandled anyone. He admits he used abusive language; he says he got angry when he saw stadium officials pushing the children, who were playing with a ball on the sidelines.

    Fitness expert Deanne Pandey, whose children were among those that had accompanied Shah Rukh Khan’s children to the stadium said, “My son was there with SRK & other kids, @iamsrk did the right thing by protecting our babies, why doesn’t the media/officers see that, so angry,” she had tweeted. The photograph used here shows the children playing on the field.

    He has also found much support in the film industry.”

    What happened at the Wankhede: An eyewitness account

    A 14-year-old boy, who was with Shah Rukh Khan [ Images ] when the spat at the Wankhede stadium took place on Wednesday night, is horrified. He finds unacceptable the television footage about the event. He thinks most of it is bunkum.

    Only when a Bollywood actor’s daughter was pushed by ‘rowdy’ members of the Mumbai Cricket Association, the boy says, did Shah Rukh Khan lose his cool.

    The teenage eyewitness alleges that these MCA members, who had an issue with the children, were drunk and upset because the Mumbai Indians [ Images ] had lost a decisive game to Shah Rukh’s Kolkata Knight Riders [ Images ] in the Indian Premiership League.

    Sukhminder Lamba, the boy’s father, told Rediff.com, “It is amazing to see the media devour Shah Rukh Khan for protecting the children. I am sure at some point in time every parent has gone through a similar situation and has been provoked and reacted to a greater degree. The boys were pushed around by the security men even though they were making their way back quietly.”

    Lamba says his son told him that Shah Rukh Khan reacted only when girl children were pushed and allegedly manhandled by MCA members.

    The children, he says, were with Shah Rukh Khan from the time he entered the Wankhede till they left. Not once did Khan abuse a female spectator, as is claimed in the First Information Report filed by some MCA officials.

    Lamba told Rediff.com, “After watching the allegations made by the MCA officials, these kids have realised that the human mind is the devil. The cooked up allegations by the MCA officials have taught these kids that lies are a way of life, that truth never wins in the face of absolute power.”

    “Will the MCA brutes have the gumption to say how Shah Rukh Khan was abused and provoked into reacting and the kind of language they used to start the fracas?” Lamba asked.

    Importantly, the businessman, who knows Khan well, says repeatedly that “The abuses used by them, if ever revealed, will have hell breaking loose. Shah Rukh Khan has shown great maturity and understanding in keeping silent.”

    Media is going overboard in demonzing SRK..I dont think it ll hv ne impact whatsoever in SRK’s popularity

    The Truth starts pouring out.Will any MCA official be able to handle it if even one girl says–Yes I was manhandled.They have acted too swiftly and now they are feeling the heat. SRK again shows why is he the biggest newsmaker in India.Yes “newsmaker”–the man who can create a national storm/national story instantaneously.That’s baadshah Khan for you.Though I feel he should shun such negativity around him.

    Much has been said about Shah Rukh Khan’s [ Images ] brawl with Mumbai [ Images ] Cricket Association officials at the Wankhede stadium on Wednesday night. Both sides have given their versions about what happened that night.

    But what really happened? Which version is right?

    We spoke to Maheep Kapoor, actor Sanjay Kapoor’s wife, whose 12-year-old daughter Shanaya was one of the children accompanying SRK [ Images ] that night.

    Here’s what she told Sonil Dedhia:

    “The kids went on the ground and started playing cricket. If they have committed a mistake, that doesn’t mean they have committed a crime. I think the issue is just blown out of proportion,” Maheep told Rediff.com

    “I respect what the MCA officials said. Even if the kids are wrong, that doesn’t give them a right to be aggressive. Also, Shah Rukh is not a fool. He abides by the rules. I have seen team owners like Vijay Mallya [ Images ] and Preity Zinta [ Images ] walking on the field. What is so wrong if Shah Rukh did it?”

    “Shah Rukh had gone to pick up the kids,” she continues. “It is ridiculous because he was just being a protective parent and guardian to the many children present there, including my own.”

    “I don’t think any parent would like to see a child being manhandled. Shah Rukh had to react because the security guard was aggressive with the children and even pushed a 12-year-old kid. It was not required. As a parent, even I would have reacted in a similar manner,” Maheep said.

    While some MCA officials and one police officer have alleged that Khan was drunk, Maheep denies it. “It’s bizarre. Shah Rukh is a social drinker. I don’t think he would ever drink when he is around kids. Just because he is a star, people are trying to frame him.”

    Maheep feels Khan was provoked by MCA officials. “Why just blame Shah Rukh Khan for taking charge of a situation in the face of out-of-line security? He is a thorough gentleman. I have known him and his wife Gauri for 16 years. He is magnanimous and chivalrous. I am sure he was pushed to the limit, and that’s why had to use the (abusive) language in the verbal spat that took place.”

    Maheep’s daughter will attend the Kolkata Knight Riders [ Images ] game on Saturday.

    “My daughter is flying with him tomorrow to Pune and then Kolkata,” says Maheep, adding, “I am not worried because I know she will be taken care of. He has always taken care of our kids. I know she will be safe and sound with him.”

    SRK never hit me: MCA guard

    MCA security guard Vikas Dalvi, who is at the centre of the spat between the cricket association and Team Kolkata co-owner Shah Rukh Khan, has clarified that the actor never hit him. The 52-year-old, however, added that others accompanying Khan, presumably his bodyguards, did manhandle him.

    “When I stopped Khan and the children, the people who were with him pushed me and said ‘yeh ground hum ne khareed lee hai (we have bought this ground)’,” Dalvi was quoted as saying on a news website. “I told them that it was past closing time and that they could not enter the ground, after which Shah Rukh Khan started abusing me and his companions manhandled me. I could clearly smell alcohol during the entire incident.”

    Following the episode, Dalvi has gone on leave. The security guard is reportedly being shielded from the media by MCA and has not been allowed talk to newspersons. “He wanted a four-day leave, saying he was tired after what happened,” said a senior MCA official. There are also varied versions about Dalvi’s conduct over the years. While an MCA official said he was a “very well-mannered” man, a TV reporter claimed that Dalvi had misbehaved with mediapersons earlier.”

While some said that the association has a right to prevent entry of a person who is found to have broken stadium rules – in this case, allegedly manhandling MCA officials – others called the punishment “disproportionately harsh”.

    A senior Delhi-based lawyer said there are rules of a stadium and each stadium makes its own rules and if a person breaks them, he or she has to face the rap.

    But senior counsel C A Sundaram, who has represented Bin the past, said that ultimately the parent board has a duty, and not just responsibility, to deal with a situation as ‘patria familas’ (head of the family). “Nobody can believe that the rules that apply to everyone do not apply to them. Who decides the rules? It is the BCCI. At the end of it, BCCI will have to decide as it is the body that regulates the game of cricket in India,” Sundaram explained.

    Khan need not wait for BCCI to step in. Lawyers said he could move the civil courts in Mumbai or the Bombay high court to question MCA’s powers to issue the ban, the grounds it was issued on, the lack of natural justice, the absence of a show-cause notice to hear his side first, his right as a citizen to enter a stadium where matches are played for the public, and the quantum of the punishment. “Ticket holders do not have an automatic right of entry and can be barred for behaviour that is unjustified or against the rules,” said lawyer Amit Desai. “The ban on Khan, however, is a very harsh punishment.”

    Another lawyer felt that BCCI has no immediate role in the resolution passed by MCA. “Franchisees hire the cricket grounds. Wankhede belongs to MCA, it can impose its rules. But can any person who allegedly got rough with MCA officials be banned for five years. It is sheer nonsense,” said the lawyer.

    Yet another lawyer said that, as an IPL team owner, Khan should be allowed to enter Wankhede.”

    I completely agree with Adv. Amit desai’s remarks, SRK was not treated as a normal citizen but just because of the media hipe the process of convicting SRK for his action were fast tracked and due to that many main process step were skipped.

    whatever happened in Mumbai was the fault of MCA people…its the owner of the team sitting there, he does have the right to be happy,that goes without saying. But unfortunately people in MCA are too egotistic for nothing, those attention seekers and bigoted people thought he should be punished and that happened. Its thoroughly dissapointing and drains my confidence as a free man,(although i dont advocate drinking where its not allowed).As Amit desai said , this punishment is too harsh and i second him.I’m sure millions more will agree

    What Senior Advocate Amit Desai has said clarifies all the doubts people had on the possibility of a person been banned from a ground even after taking a ticket and was the ban justified.
